Important Notice
These Terms apply to AutoShopCalls’ website, demo line, forms, private setup links, checkout flows, and related platform features for auto repair shop AI call answering. Paid Services may also be governed by a Master Services Agreement, Statement of Work, order form, invoice, or checkout flow. If those documents conflict with these Terms for paid Services, the more specific paid-service document controls.
AutoShopCalls is a workflow and AI call answering service for auto repair shops. AutoShopCalls does not diagnose vehicles, prepare binding estimates, guarantee repair outcomes, make safety determinations, or replace your service advisors, technicians, or management team.
1. Agreement to Terms
These Terms of Service (“Terms”) govern access to and use of the AutoShopCalls website, live demo line, scheduling pages, checkout flows, intake forms, private setup pages, communications, dashboards, and related software or services made available by AutoShopCalls (“AutoShopCalls,” “Company,” “we,” “us,” or “our”). AutoShopCalls is owned by BizAssistant.ai LLC.
By accessing the website, calling a demo line, submitting a form, booking a demo, using a private setup link, activating a paid plan, paying an invoice, or otherwise using the Services, you agree to these Terms. If you use the Services on behalf of an auto repair shop, you represent that you have authority to bind that shop.
The Services are offered for business and commercial use only and are not intended for personal, family, household, or consumer use.
2. Services Covered
The Services may include AI call answering configuration, inbound call answering, missed-call recovery, busy-line and overflow coverage, lunch, weekend, and after-hours coverage, SMS follow-up where enabled, call summaries, transcripts, routing, escalation rules, appointment request capture, booking handoff support, onboarding, tuning, reporting, and related website or workflow features.
The Services are designed for auto repair shops and related approved shop workflows. The Services are not designed for unrelated industries or for high-risk uses outside the approved call flow.
3. Auto Repair Boundaries
Customer is solely responsible for approving scripts, intake questions, disclosures, escalation rules, urgent-call instructions, pricing statements, warranty language, diagnostic language, deposit and cancellation language, and any customer-facing content used with the Services.
Customer must not configure or use the Services to diagnose a vehicle, provide a binding repair estimate, promise a repair outcome, guarantee vehicle safety, make final scheduling decisions when human approval is required, or replace qualified shop staff.
Calls involving uncertain pricing, safety concerns, towing, no-start conditions, brake concerns, status disputes, warranty questions, complaints, or other sensitive customer situations should be handled according to Customer-approved escalation rules.
4. Accounts, Forms, and Setup Links
You agree to provide accurate information when submitting forms, using private setup links, activating checkout, or providing onboarding materials. You are responsible for maintaining the confidentiality of any private setup links, account access, calendar links, credentials, phone-system access, or workflow materials provided to you.
AutoShopCalls may rely on information you submit to configure call flows, summaries, routing, booking handoff, and follow-up workflows. Delays or inaccuracies in your information may delay launch or affect workflow quality.
5. Pricing, Plans, Trial, and Usage
The current public offer is an Auto Repair AI Call Answering plan at $399/month for one independent auto repair shop location, with setup included, unlimited inbound AI-handled calls and AI-handled call minutes for normal shop use, and a 14-day free trial unless another amount or term is stated in an order form, checkout flow, invoice, Statement of Work, or signed amendment.
The current public offer is not a routine per-call or per-minute overage model for normal single-shop inbound call volume. Use remains subject to lawful use, acceptable use, platform security, carrier rules, fair-use limitations, and any specific limits stated in an applicable written order form, checkout flow, invoice, or Statement of Work.
Pass-through carrier charges, custom work, third-party charges, integrations, unusual support needs, additional shop locations, outbound campaigns, unusually high SMS usage, or custom add-ons may be billed separately if stated in the applicable checkout, invoice, order form, or Statement of Work.
6. Billing and Payment
A payment processor may be used for paid Services after the 14-day free trial or for separately agreed paid work. Fees, billing cadence, taxes, payment method rules, subscription terms, renewal terms, and cancellation instructions may be stated in the applicable checkout flow, invoice, order form, or Statement of Work.
Unless a separate written agreement states otherwise, fees are due in advance and are non-refundable once paid, except where AutoShopCalls chooses to provide a credit or refund in writing or where required by law.
7. SMS, Calls, Recording, and Consent
Customer is responsible for providing legally required notices and obtaining legally required consents for call recording, call transcription, SMS/text messaging, AI disclosure, telemarketing, privacy, and related communications. Customer is responsible for honoring opt-outs, do-not-call requests, and communication preferences.
AutoShopCalls may provide tools or workflow language to help support consent and disclosure processes, but Customer remains responsible for deciding what notices, scripts, and consents are required for its shop and jurisdiction.
8. Acceptable Use
You may not use the Services to violate law, impersonate others, mislead callers, send unlawful messages, collect data without required consent, transmit harmful code, interfere with systems, create fake or abusive call traffic, resell the Services without written permission, or use the Services in a way that creates unreasonable operational, legal, security, or reputational risk.
AutoShopCalls may suspend or limit Services if we reasonably believe use is unlawful, unsafe, abusive, high-risk, non-compliant, unpaid, technically disruptive, or outside agreed scope.
9. AI Output and No Guarantees
AI-generated output may be incomplete, inaccurate, delayed, misunderstood, or inappropriate for a particular situation. Customer is responsible for reviewing outputs, supervising workflows, and making final business, repair, estimate, scheduling, customer-service, and operational decisions.
AutoShopCalls does not guarantee bookings, revenue, car count, repair orders, lead quality, appointment volume, answer rates, uninterrupted service, or return on investment.
10. Third-Party Services
The Services may use or connect with third-party telephony, SMS, email, calendar, CRM, payment, hosting, analytics, AI model, or workflow providers. Customer is responsible for complying with applicable third-party terms and for maintaining access to any systems Customer asks AutoShopCalls to use.
11. Intellectual Property
AutoShopCalls and its licensors retain ownership of the platform, software, workflows, templates, designs, know-how, documentation, analytics, and service improvements. Customer retains ownership of its business content, brand materials, approved scripts, and customer data, subject to the rights granted to AutoShopCalls to provide the Services.
Customer grants AutoShopCalls a limited right to use Customer-provided materials as needed to configure, operate, support, secure, improve, and document the Services.
12. Privacy and Data
Our Privacy Policy explains how we collect, use, disclose, and protect information. Customer is responsible for its own privacy notices and legal basis for submitting caller, customer, staff, vehicle, and shop data to the Services.
Where a separate data processing agreement, order form, or Statement of Work applies, that document controls to the extent it conflicts with these Terms.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. AUTOSHOPCALLS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ERROR-FREE OPERATION.
No statement on the website, in a demo, in a call summary, or in an onboarding communication creates a guarantee unless expressly stated in a signed written agreement by AutoShopCalls.
14. Limitation of Liability
To the maximum extent permitted by law, AutoShopCalls will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost profit, lost revenue, lost business, loss of goodwill, loss of data, or substitute service damages.
To the maximum extent permitted by law, AutoShopCalls’ total aggregate liability for all claims relating to the Services will not exceed the amounts paid by Customer to AutoShopCalls for the Services giving rise to the claim during the three months before the event giving rise to liability.
15. Indemnification
Customer will defend, indemnify, and hold harmless AutoShopCalls from claims arising out of Customer’s shop operations, content, scripts, instructions, customer communications, repair descriptions, pricing language, advertising claims, consent practices, privacy practices, regulatory obligations, use of the Services, or violation of these Terms.
16. Termination
You may stop using the website at any time. Paid Services may be cancelled or terminated according to the applicable checkout, order form, invoice, Statement of Work, or Master Services Agreement. AutoShopCalls may suspend or terminate access for nonpayment, security risk, unlawful use, unsafe use, or material breach.
17. Dispute Resolution
Before bringing a formal claim, the parties agree to try to resolve disputes informally by written notice and good-faith discussion. Any dispute not resolved informally will be handled under the dispute provisions in the applicable Master Services Agreement if one exists.
Where no Master Services Agreement applies, disputes will be governed by California law, excluding conflict-of-law rules, and the parties consent to venue in San Diego County, California, except where another venue is required by law.
18. Changes
AutoShopCalls may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the Services after the updated Terms are posted means you accept the updated Terms.
